About Prove the Market
Prove the Market is a sole proprietorship operating under a certified assumed business name filed in Suffolk County, New York. The customer-facing seller and service name is Prove the Market.
Acceptance of these Terms
By accessing or using the service, you agree to these Terms and the Privacy Policy. If you do not agree, do not submit information or use a report.
Eligibility and permitted use
You must be legally able to enter an agreement where you live. Use the service only for lawful business research and submit only information you are authorized to use. Reports are not professional legal, tax, accounting, lending or investment advice.
Description of the service
Prove the Market organizes available market evidence, competitor listings, demographic context, researched business inputs and transparent estimates into local business opportunity reports. Coverage and available evidence vary by business and market.
Free reports
A free report provides an initial market view and may show only part of the available evidence. Eligible free or informational pages may later contain clearly identified advertising after the advertising provider and required privacy controls are approved and enabled.
Paid reports
Paid Complete Reports are offered through Prove the Market for $39 USD as a one-time purchase with no subscription. Applicable sales tax is calculated at checkout. Pricing and refund terms are displayed before purchase. Payment does not improve a score or change a conclusion. Paid reports are ad-free.
Payments
Stripe processes Complete Report card payments. Prove the Market does not store full card numbers. Checkout displays the amount and currency before payment, and paid access will be granted only after successful payment is securely verified. Any applicable tax treatment remains subject to the checkout configuration and applicable requirements; the planned report price is not a statement about taxability.
Refund policy
Submit refund requests to support@provethemarket.com within 7 calendar days of purchase. A full refund is available when a Prove the Market technical failure prevents report generation or paid access, a material technical or data-processing failure makes the delivered report substantially unusable, a duplicate payment occurs, or another clear Prove the Market processing error causes an improper charge.
Other dissatisfaction requests received within 7 calendar days are reviewed individually and are not guaranteed a refund. Standard refunds are full refunds; Prove the Market does not ordinarily issue prorated or partial refunds. When a full refund is issued, paid access may be revoked. Payment and refund audit records remain preserved as reasonably required for accounting, disputes, fraud prevention and legal obligations.
Report assumptions and limitations
Reports depend on third-party coverage, source quality, geographic matching and information available when created. Listings may be missing, outdated or incorrectly categorized. Ratings and reviews do not establish market share, revenue, capacity or business quality.
Observed information, calculations, modeled assumptions and missing inputs are identified separately where practical. Validate estimates with current local quotes, regulations, customer interviews and operating facts before investing.
Actual and Estimated inputs
Paid reports may let you label scenario inputs as Actual or Estimated and recalculate a planning case. Those labels reflect your assessment; Prove the Market does not independently verify them. Scenario changes are session-only and do not rewrite the saved historical report.
No guarantee of business results
Prove the Market does not guarantee revenue, profit, customers, market share, break-even timing, business survival, financing, regulatory approval, licensing or exact startup costs. A score or conclusion is a planning aid, not a probability or recommendation to invest.
Third-party data and services
The service may rely on Stripe, Resend, DataForSEO, U.S. Census data, OpenAI, Supabase, Vercel, Google and linked public sources. Their availability, terms and data can change. A link, listing or citation is not an endorsement. Prove the Market does not control third-party content or guarantee that it is complete or current.
Creator material and user-submitted content
You remain responsible for business descriptions, online content creator links, transcripts, pasted text, media, Actual or Estimated inputs and other submitted material. You authorize Prove the Market to process that material as needed to provide, secure, support and improve the service. Do not submit confidential material, sensitive personal information or content you do not have permission to use.
Prohibited uses
- Breaking laws or infringing another person’s rights.
- Bypassing report access, payment, security or rate limits.
- Probing, disrupting or overloading the service or its providers.
- Submitting malicious instructions, files or deceptive content.
- Scraping or redistributing the service contrary to these Terms.
Intellectual property
Prove the Market owns its site design, original wording, analysis structure and software. Third-party sources retain their rights. You may use your report for your own business evaluation; these Terms do not transfer ownership of the service or third-party material.
Report access and recovery
Report access uses authorized browser grants and verified recovery links. Keep recovery links private. Support may verify a paid purchase through checkout records before restoring access. A report ID or email address alone does not grant access.
Service availability
The service may change, be interrupted or become unavailable because of maintenance, provider failures, safety controls or events outside our reasonable control. Prove the Market may correct errors, limit usage or suspend an unreliable feature.
Privacy
The Privacy Policy explains the information processed to create, deliver, recover and support reports, including applicable retention and deletion practices.
Suspension and termination
Prove the Market may restrict access to address abuse, fraud, security risk, unlawful activity or a material breach of these Terms. Required recordkeeping may continue after access ends.
Disclaimers
The service and reports are provided on an “as available” basis. To the fullest extent permitted by law, Prove the Market disclaims warranties concerning completeness, accuracy, availability and fitness for a particular business decision. Rights and warranties that cannot lawfully be waived remain unaffected.
Limitation of liability
To the fullest extent permitted by law, Prove the Market is not liable for indirect, incidental, special or consequential losses arising from use of the service or a business decision. Any liability for a paid report is limited to the amount paid for that report. This limitation does not apply where applicable law does not permit it.
Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Subject to non-waivable consumer rights or other law requiring otherwise, disputes must be brought in an appropriate New York State court located in Suffolk County, New York, or an applicable federal court serving Suffolk County, New York.
Changes to these Terms
Prove the Market may update these Terms as the service or applicable requirements change. The effective date above identifies the current version. Material changes will be communicated as required.
